Proper Group AG, formerly Utopia Music AG, is facing bankruptcy proceedings initiated by a Swiss court. The "provisional announcement of bankruptcy" was filed on Tuesday after Proper Group failed to attend a court hearing regarding a CHF 23,000 debt.
The legal action was brought by MME Legal, a consultancy based in Zug, which describes itself as an “innovative consulting company” specializing in blockchain and digital assets. MME noted its expertise in helping clients develop and operate digital or blockchain-based applications.
A Proper Group spokesperson told CMU that the company was unaware the proceedings had been initiated, leading to their absence at the hearing, which resulted in a default ruling in favor of MME Legal.
The spokesperson expressed disappointment over the situation, explaining that the company was unaware of the legal process surrounding the relatively small debt, and consequently missed the hearing.
CMU reports that the incident is tied to a downsizing process within Proper Group, which left the company without the necessary staff in its Swiss offices to handle the hearing notice in a timely manner. The company is now implementing measures to prevent such oversights in the future.
Despite this, Proper Group will now need to prove to the court that the debt has been paid and that the company remains financially solvent.
